A Morgan County man accused of kidnapping and then killing his estranged girlfriend will not face the death penalty in the case.

The Morgan County Commonwealth's Attorney says at the request of Melissa Patrick's family, he will not seek the death penalty against Robin Maple. Maple is accused of kidnapping his estranged girlfriend then shooting and killing her.

In another new development, it looks like the trial will be moved to Carter County. If not there, it will take place in Johnson or Boyd County.
